July 2023 and July 2025, ten new claims for damages were filed with the TDLC, seven of which were based on abusive conduct previously sanctioned by the same court, while only three concerned compensa - tion for damages to consumers arising from collusive agreements. Furthermore, following the recent Supreme Court decision in the Papelera Cerrillos v SCA/CMPC case, claims for damages based on abuse of dominance may increase, as the standard for proving causation under that ruling is relatively flexible and appears to rely primarily on the court’s “prudential” judgment.
