However, the NJDEP has critically included an expan- sion of the existing legacy provisions for the underly- ing regulations to allow applicants to continue to rely on and apply the current regulations and requirements for any complete applications submitted within 180 days of the effective date of the new regulations, or by July 2026. Conclusion The environmental legal landscape in New Jersey is ever-changing, with additional restrictions and obliga- tions being adopted in order to better preserve the
state’s environmentally sensitive areas and to protect against the anticipated climate change impacts. The above proposed amendments to various environmen- tal rules and regulations, if adopted, are expected to significantly impact how property owners and opera- tors complete environmental investigations and reme- diation, how environmental due diligence is conduct- ed throughout the state in connection with potential site acquisitions, and how property owners are able to develop their properties, especially in areas which may be impacted by climate change-driven sea level rise and flooding.
