Unlike traditional marks, these signs are not always capable of static or purely visual representation, which may create challenges both in registration and enforcement. Establishing clear parameters for their representation – whether through technical descrip- tions, digital files, or a combination of both – will be essential to ensure legal certainty. Although some argue that such concepts could already be inferred under the previous legal frame- work, their express recognition removes ambigu- ity and aligns the Mexican system with international trends. This, in turn, may encourage companies to adopt more sophisticated approaches to protecting their distinctive assets. From a strategic perspective, these new categories can significantly strengthen IP portfolios, particularly in highly competitive markets where differentiation is critical. The ability to protect dynamic or sensory ele- ments allows brands to develop more complex and harder-to-replicate identities. Nevertheless, their effective use requires an integrated approach combining legal, commercial and marketing considerations. It is not merely a matter of registration, but of building and consolidating a clear market pres- ence supported by consistent use that enables both recognition and enforceability. Procedural timelines before IMPI A central objective of the reform is to enhance the efficiency of the industrial property system by stream- lining administrative procedures. To this end, reduced timelines for IMPI’s actions have been introduced, addressing a longstanding demand for greater certainty and faster resolution of proceed- ings. However, while these changes aim to correct struc- tural delays, they also raise concerns. The key chal- lenge lies in ensuring that increased efficiency does not come at the expense of technical quality or con- sistency in decision-making. In other words, speed must not undermine legal soundness.
The reform establishes maximum legally binding time- frames: five months for trade mark registration deci- sions, three months for renewals, and two months for the recordal of trade mark licence agreements. These changes introduce a new level of predictability, allow- ing businesses to better plan their IP strategies. Additionally, the possibility of sanctions for public officials in cases of non-compliance reinforces insti- tutional accountability. However, it may also create internal pressures, particularly in high-volume environ- ments, making the balance between efficiency and rigour even more critical. From a strategic standpoint, both authorities and users must adapt to a more dynamic system in which timing becomes as important as substantive quality. Interplay Between Industrial Property and Copyright Protection of cultural heritage The reform strengthens the protection of assets linked to cultural heritage through industrial property mecha- nisms, particularly appellations of origin, geographical indications and distinctive signs associated with col- lective identity. While measures have been introduced to facilitate recognition, structural challenges remain. Mexico still lacks a comprehensive system for identifying and managing protectable cultural assets, as well as clear mechanisms for determining collective ownership and efficient models for economic exploitation. Therefore, while the reform seeks to create a more coherent framework, the substantive model for cul- tural protection remains under development. Copyright reservations Within the Mexican copyright system, reservations of rights constitute a unique figure granting exclusive rights over certain distinctive elements associated with artistic activities. Under Article 173 of the Federal Copyright Law, this protection covers elements such as titles, names, denominations, distinctive physical and psychologi- cal characteristics, and original operational features
