International Arbitration 2026

BOTSWANA Trends and Developments Contributed by: Thembani Jeremiah, Tebogo Edison Tladi, Kaone Marumoloa and Magadi Lesego Mphothwe, Jeremiah Tladi & Co

Looking ahead Botswana’s arbitration landscape is still, by regional standards, a developing one, and it would be prema - ture to describe the jurisdiction as a mature arbitration hub on a par with its more established neighbours. What is clear, however, is that the direction of travel, both in the commercial and employment spheres, is towards greater institutionalisation, closer regional co-operation and a more predictable framework for resolving disputes outside the ordinary courts. For international investors, financiers and their counsel, that is a trend worth following closely over the com - ing year, particularly as the practical effects of the change in government, the economic pressures fac - ing the state, and the newly institutionalised alliance with AFSA continue to play out.
