In recent decades, the value of the Land Court system has been questioned because of the availability of pri - vate title insurance and the difficulty of the processing backlog. To alleviate the strain, in 2009 the legislature initially allowed the deregistration of fee simple time - share interests, and by 2013 authorised the voluntary deregistration of all fee simple properties. Significant numbers of deregistration applications began to fol - low, but the recent seven-year backlog has prompted mass deregistration across the state. Notably, legis - lation introduced in the 2025 session proposes to eliminate the Land Court system entirely and transi- tion all property records to the Regular system. As of 2026 the bill remains in committee, but its introduction demonstrates the continued trend toward abandon - ment of the Land Court system.
