Service provider liability is governed by the EU legisla - tive framework. Under the “safe harbour” provisions contained in the EU E-Commerce Directive (2000/31/ EC), marketplaces and ISPs are not considered liable for infringing material until they have actual knowledge of it and fail to act promptly. There is no statutory requirement in Ireland for service providers to demand proof of trade mark or copy - right registration before removing infringing material. However, some marketplaces may require evidence of trade mark registration as part of their internal poli - cies. There is no copyright registration framework in Ireland.
