Conclusion The Supreme Court’s judgment in Commissioner of Trademarks v Kviscal Services Co Ltd (Application for Leave to Appeal (Civil) 5743/24) clarifies and fortifies the principles underlying trade mark registration in Israel. While acknowledging the commercial utility of co-existence agreements, the Supreme Court empha - sises the statutory discretion of the Israel Trademark Office and the paramount importance of consumer protection in trade mark law. Private contractual agreements cannot overshadow the public interest or override statutory safeguards against confusion; instead, they serve as one factor within the evaluative framework of the Israel Trademark Office. Conditional registrations remain a valuable tool for balancing trade mark rights with marketplace clarity.
