Conclusion APOs in Malaysia are not relics. They are rare but necessary safeguards for the integrity of civil pro - ceedings, especially in the modern digital era when evidence can vanish faster than legal proceedings can even convene. The modern legal framework in Malaysia has matured to keep this remedy within its principled boundaries. Furthermore, the emergence of newer reliefs introduced by the courts as seen with DDOs ensure that courts can opt for less intrusive alternatives when appropriate. However, when the facts of the case show a real, immediate risk of destruction of evidence and when the evidence concerned is complex, concealed or purely digital, APOs remain indispensable. Far from obviating them, Malaysia’s evolving practice has refined them into a tool that preserves the truth of the matter without trampling on rights. We opine that such an equilibrium, not abolition, is the right future for APOs in Malaysia.
