Finally, if an application for summary return is not appropriate, a parent outside Australia could still make an application for parenting orders if the child is pre - sent in Australia, including seeking an order that the child reside with them in the other country. A parent outside Australia may be eligible for a grant of Legal Aid for parenting proceedings if they meet the means and merit tests. It is also possible for a parent outside Australia to seek the court’s permission to participate in the proceedings remotely.
