SOUTH AFRICA Law and Practice Contributed by: Beverley Clark, Jana van Breda, Elmarie Erasmus and Lauren Christie, Clarks Attorneys

Clarks Attorneys is one of South Africa’s pre-eminent boutique family law firms, working at the cutting edge of the rapidly changing field of family law in South Africa, and specialising in matters with an interna ‑ tional angle. The firm is situated in Johannesburg, South Africa’s largest city, but services clients from around the country and elsewhere in the world. It has extensive experience in those areas usually associ ‑ ated with family law, such as divorce and termina ‑ tion of domestic partnerships, parental rights and re ‑

sponsibilities, maintenance and adoption. It also has particular expertise in high net worth divorces, trusts, international child abduction, foreign divorces for expatriate or non-resident South Africans, divorces between South Africans and foreign or non-resident spouses, prenuptial agreements (both domestic and multi-jurisdictional) and all manner of cases involving children. The firm hosts a highly regarded family law conference every spring in Johannesburg. Elmarie Erasmus is a director of Clarks Attorneys. Since joining the firm, she has achieved success in several important public interest cases, notably against the state in a transgender rights matter, and in the landmark KG v Minister of Home Affairs case, which has changed the law as it relates to prenuptial contracts. Elmarie works frequently with high-value financial cases, but matters relating to children are closest to her heart.
