Legal and Economic Landscape in Iraq Iraq has long been a focal point of geopoliti - cal interest and economic potential, thanks to its rich natural resources, strategic location and emerging market opportunities. Over the past two decades, the country has undergone a sig - nificant transformation, especially after the fall of the Saddam Hussein regime, and has seen a shifting legal landscape aimed at encourag - ing foreign investment. This article highlights the ongoing trends and developments in Iraq, espe - cially within its legal framework, that are pivotal for business operations and investments. The Federal Supreme Court: Legal Authority and Challenges A significant element of Iraq’s evolving legal sys - tem is the role played by the Federal Supreme Court. This body has been central to Iraq’s legal and political discourse, ensuring that the gov - ernment remains compliant with the constitution and determining the legality of policies, laws and actions taken by various authorities. The Federal Supreme Court is constitutionally tasked with overseeing matters of constitution - ality, with its decisions being deemed final and binding across all governmental institutions. Article 94 of the 2005 Iraqi Constitution explic - itly outlines this authority, affirming that deci - sions made by the Federal Supreme Court are not subject to appeal. However, the Court’s own legitimacy has been a topic of debate for years. The current iteration of the Federal Supreme Court was established under Law No 30 of 2005, following the Transitional Administrative Law implemented after the 2003 invasion. This legal basis, however, was annulled by Article 143 of the 2005 Constitution. As a result, the Con - stitution provides for a new Federal Supreme Court to be established via a law passed by a
two-thirds majority in the Iraqi Council of Rep - resentatives. Unfortunately, this law has not yet been enacted, and the existing Court continues to function despite its unclear legal foundation. Despite these unresolved legal questions, the decisions issued by the Federal Supreme Court have had significant consequences, both legally and politically. The Court has ruled on pivotal matters, such as the salary payments to Kurd - istan employees, which had been delayed for months, and it imposed regulations requiring the Kurdish government to transfer all oil and non-oil revenues to the central government in Baghdad. Furthermore, the Federal Supreme Court recent - ly made rulings declaring certain provisions of the Kurdistan Parliament Election Law uncon - stitutional. These decisions raised significant concerns among Kurdish political parties, with many viewing these rulings as undermining federalism and the autonomy of the Kurdistan Region. These rulings have led to political ten - sions and may shape the future of Iraq’s federal governance system. The recent overruling by the Court of Cassa - tion of a decision previously made by the Fed - eral Supreme Court has further complicated the situation. This legal development raises ques - tions about the potential for future challenges to the Court’s authority, especially with respect to Kurdish autonomy. If the Federal Supreme Court’s decisions are no longer seen as final and binding, it could lead to more legal challenges, further undermining the judiciary’s legitimacy. Observers note that the ongoing legal uncer - tainty affects foreign investors, as businesses require a stable legal framework to confidently operate in Iraq.
