A corresponding legislative proposal was not finalised in the last legislative period and it remains to be seen when the new government will take up this legislative proposal again. The Product Liability Directive (EU) 2024/2853 is not directly applicable in EU member states and must be implemented into national law. The deadline for implementation is 9 December 2026. It remains to be seen how the German legislature will specifically implement the new obligation to disclose evidence, which is cur - rently unknown in German law.
