13.5 Binding of Third Parties An award will be binding on a third party if that third party was a party to the arbitration ‒ for example, through joinder. Otherwise, there are no provisions within the arbitration laws on the binding effect of arbitral awards on third parties.
Section 38 of the ADGM Arbitration Regulations per - mits consolidation. The Federal Arbitration Law and the DIFC Arbitration Law are silent on consolidation and therefore do not expressly prohibit consolidation. It would follow that if the parties agreed to arbitration pursuant to the DIAC Rules or ArbitrateAD Rules, irre - spective of which seat is nominated within the UAE, then consolidation would be permissible.
