Given the debtor’s financially distressed position and the high likelihood that the third parties whose liability is sought may engage in asset stripping, credit pro- tection measures may be adopted, such as a pre- judgment freezing injunction over those third parties’ assets. In any event, once the application is granted, the respondents become jointly and severally liable for satisfaction of the claim, under Article 942 of the Civil Code.
