14.2 Growth Areas The main area of growth for commercial disputes in Romania in 2025 lies in energy-related and infra- structure disputes, both heavily influenced by ongoing regulatory and market shifts. In the energy sector, the accelerated transition towards renewables, the gradual removal of price caps, and frequent legislative changes have generated a sig- nificant increase in disputes over long-term supply agreements, change-in-law clauses and investment protection. Market participants are increasingly seek- ing arbitration or hybrid dispute resolution mecha- nisms that can provide stability and predictability in a fast-moving regulatory environment.

At the same time, construction and infrastructure dis- putes continue to grow in number and complexity, driven by Romania’s ambitious EU-funded develop- ment projects. Common issues include cost esca- lations, delays, performance guarantee claims, and challenges related to project termination or non-per- formance. With new procurement rules and height- ened scrutiny over public contracts, these disputes are expected to intensify over the coming months.
