A shift towards a sustainable justice model Organic Law 1/2025 introduces ADR as a procedural requirement in civil and commercial disputes, includ - ing cross-border conflicts where at least one party is domiciled in Spain. The law defines ADR as any negotiation activity undertaken in good faith to resolve disputes extrajudicially, either directly between parties or with the assistance of a neutral third party. This includes: • mediation; • conciliation; • arbitration; • confidential binding offers; • independent expert opinions; and • collaborative law. By making ADR mandatory, the law seeks to promote a more sustainable justice model that prioritises dia - logue over adversarial litigation, thereby reducing the burden on courts and offering faster, less costly reso - lutions. The Need for Careful Design in ADR Implementation Crafting effective ADR mechanisms The success of Organic Law 1/2025 hinges on the careful design and implementation of ADR mecha - nisms. For ADR to be effective, it must be accessi - ble, impartial and tailored to the specific needs of the parties involved. The law recognises a variety of ADR methods (as listed above), each with distinct charac - teristics. • Mediation: a voluntary process where a neutral mediator facilitates dialogue between parties to reach a mutually acceptable agreement. Media - tion is formalised under Law 5/2012 and must not exceed three months. • Conciliation: an expert conciliator with relevant technical or legal knowledge proposes solutions to resolve disputes. • Arbitration: a binding process where an impartial arbitrator issues an enforceable award, equivalent to a court judgment. • Confidential binding offer: a party makes a bind - ing offer that, once accepted, becomes irrevoca -

In response, Organic Law 1/2025, enacted on 2 January 2025 and published in the Official State Gazette (BOE) on 3 January 2025, introduces a transformative approach to dispute res - olution in Spain. This legislation marks a paradigm shift by mandating the use of Appropriate Means of Dispute Resolution (ADR, or Medios Adecuados de Solución de Controversias (MASC) in Spanish) as a prerequisite for filing lawsuits in civil and commercial matters. This article explores the necessity of adopt - ing ADR under Organic Law 1/2025, emphasising the importance of careful design in its implementation, the critical role of confidentiality and the specific excep - tions to this mandatory requirement. By examining these elements, this article aims to provide a compre - hensive understanding of how this law seeks to mod - ernise the Spanish justice system while addressing potential challenges and ensuring access to justice. The Context and Rationale for Organic Law 1/2025 Addressing judicial overload The Spanish judiciary has faced chronic issues, includ - ing an overwhelming number of lawsuits, procedural delays and a lack of specialisation in single-judge courts. These challenges have strained the Public Justice Service, undermining its efficiency and acces - sibility. Organic Law 1/2025 emerges as a cornerstone of the “Justicia 2030” initiative, which seeks to mod - ernise the judicial system through organisational, procedural and digital reforms. By requiring parties to attempt ADR before resorting to litigation, the law aims to alleviate court congestion, reduce litigation costs, and foster a culture of dialogue and peaceful conflict resolution. This aligns Spain with international trends in countries such as France, the United King - dom and the United States, where ADR mechanisms have proven effective in improving judicial efficiency.
