While a number of other states have promulgated anti-ESG laws, such as the “fair access laws” implemented in Florida, that have gone into effect and received substantial news coverage, the impact of many of these laws has yet to be seen in practice. Both pro- and anti-ESG laws are often subject to liti - gation, further obfuscating the real impact these laws may have on companies and individuals across the country. In recent months, there has also been enhanced scrutiny of companies’ DEI disclosures, ini - tiatives, and charitable giving as a result of an increase in anti-DEI campaigns. In response to such campaigns, certain leaders, most notably JPMorgan Chase CEO Jamie Dimon, have made the case for their firms’ DEI initiatives, arguing that they are good for business.
This evolving landscape, with states introduc - ing contradictory laws and rulemakings, makes compliance efforts by multi-jurisdictional finan - cial institutions challenging, and will necessitate ongoing consideration as the space develops.
