15. Appeals 15.1 Right to Appeal

15.3 Permission to Appeal No permission is required to appeal. 15.4 Rehearing of Appeal? The appeal does not take the form of a rehearing of the first-instance claim. Instead, the second-instance court reviews the legality of the first-instance judgment based on the legal grounds invoked by the appellant, with - out conducting a full rehearing of the facts ex officio.

Judgments of first-instance administrative courts may be appealed by the losing parties. 15.2 Appeal Forums Appeals are heard by the Council of State ( Con- siglio di Stato ) or, in the case of appeals against judgments issued by the Sicilian administrative court, by the Council of Administrative Justice for the Sicilian Region ( Consiglio di giustizia amministrativa per la Regione siciliana ).
