Introduction Throughout history, communication and trans- actions have been essential components of human society, with constant evolution due to the changing needs of individuals, businesses and governments. From traditional face-to-face exchanges to increasingly sophisticated elec- tronic means of communication and business transactions, people have consistently sought better, more efficient methods to interact with each other, especially across borders. These shifts have been influenced by advancements in technology, economic changes, and the evolv- ing global landscape. In the past, people relied on direct interactions and paper-based documentation to conduct various transactions, which were the accepted methods due to the technological limitations of the time. Face-to-face meetings, phone calls and physical paperwork represented the norm for most legal and business proceedings. However, the advent of the internet and digital technology has drastically transformed the way people communicate and do business. While traditional methods remain popular among cer- tain demographics, the growth and widespread use of electronic communication and digital transactions have reshaped society. The COVID-19 pandemic acted as a signifi- cant catalyst for these changes, as the virus prompted global lockdowns and social distanc- ing measures. People who were once hesitant to adopt electronic methods for communication and business suddenly had no choice but to rely on digital tools. As a result, there was a marked increase in the use of electronic means for per- sonal and professional transactions. Digital platforms allowed people to remain connected despite physical isolation, making remote com-

munication and business operations more fea- sible than ever before. With this widespread shift, electronic transac- tions have gained prominence in almost every sector of society. They offer numerous advan- tages, such as increased convenience, reduced time consumption, and the ability to save on costs. This digital shift has become an indispen- sable aspect of daily life for businesses and indi- viduals alike, facilitating everything from bank- ing transactions to legal proceedings, education and social interactions. The growing reliance on electronic transactions has highlighted the need for legal frameworks that can address the unique challenges presented by these new modes of communication and business operations. As a result, many countries, including Thailand, have updated their laws to accommodate these digital advancements, aiming to foster a secure, efficient and reliable environment for electronic transactions. Problems Despite the increasing reliance on electronic transactions, Thailand’s existing legal framework for digital transactions faces several challenges. The Electronic Transaction Act B.E. 2544 (2001) (ETA), which was initially enacted to regulate electronic transactions, has undergone several amendments over the years. However, the rap- id development of technology has made these laws increasingly outdated, leaving them unable to fully address the complexities of modern digi- tal transactions. One of the primary issues is that the ETA was designed in a time when electronic transactions were relatively novel and less widespread. As such, it primarily focused on traditional forms of digital communication, such as email and basic online transactions. As technology evolved,
