these are the regulations to be issued permitting the establishment and operation of an Article 24 Branch. Furthermore, Kuwait now has a new Digital Com - merce Law No 10 of 2026 (the “Digital Commerce Law”) published in the Kuwaiti Official Gazette on 1 March 2026. The Digital Commerce Law will enter into force one month after the publication of its Executive Regulations (which are still pending issuance). The Executive Regulations must be issued within one year of the Law’s publication. The legislation introduces a framework governing commercial activities conducted through websites, digital platforms, applications and social media channels, with the objective of enhanc - ing transparency, strengthening consumer protection and bringing greater structure to digital commercial practices in Kuwait’s online marketplace.
There have also been discussions on the following developments. • A new mortgage law that aims to address the nation’s housing challenge: this legislative move seeks to regulate the housing finance system and expand homeownership opportunities for Kuwaiti citizens. Under the proposed law, a Kuwaiti citizen could access mortgage loans with flexible repay - ment periods. This move will invigorate the finan - cial and real estate sectors. • Overhauling of Kuwait’s data privacy and informa - tion security policies: no details have been dis - closed save for certain discussions/market specu - lation.
